1. Agreement to Terms

By accessing and using the services provided by LittleFun Events ("we," "us," or "our"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and LittleFun Events. If you do not agree with any part of these terms, you must not use our services.

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our services following the posting of any changes constitutes acceptance of those changes.

2. Services Description

LittleFun Events provides professional children's party planning and event organization services, including but not limited to:

  • Custom event planning and consultation services
  • Themed decoration design and installation
  • Entertainment coordination and character bookings
  • Venue sourcing and management assistance
  • Party favor preparation and distribution
  • Photography and videography coordination
  • Catering arrangement services

The specific services provided will be detailed in your individual service agreement or contract. All services are subject to availability and may vary based on your selected package and location.

3. Booking and Payment Terms

3.1 Reservations

All event bookings require a non-refundable deposit of 30% of the total service fee to secure your date. The deposit must be paid within 48 hours of receiving our booking confirmation. Failure to pay the deposit within this timeframe may result in the cancellation of your reservation.

3.2 Payment Schedule

The remaining balance is due no later than 14 days before the scheduled event date. We accept payment via bank transfer, credit card, or approved payment platforms. Late payments may result in service modifications or event cancellation at our discretion.

3.3 Additional Charges

Any additional services requested after the initial booking or changes made within 7 days of the event may incur additional fees. These charges will be communicated to you in advance and must be paid before the event date.

4. Cancellation and Refund Policy

4.1 Client Cancellations

  • More than 60 days before event: Deposit forfeit, remaining balance refunded
  • 30-60 days before event: 50% of total fee retained, remainder refunded
  • 14-30 days before event: 75% of total fee retained, remainder refunded
  • Less than 14 days before event: No refund available

4.2 LittleFun Events Cancellations

In the unlikely event that we must cancel your booking due to circumstances beyond our control, you will receive a full refund of all payments made. We will make reasonable efforts to provide alternative dates or recommend other service providers when possible.

4.3 Postponements

Event postponements requested more than 30 days in advance may be accommodated subject to availability, with no additional fees. Postponements requested less than 30 days in advance may incur a rescheduling fee of 15% of the total service cost.

5. Client Responsibilities

As our client, you agree to:

  1. Provide accurate and complete information regarding the event, including guest count, venue details, and any special requirements
  2. Notify us of any allergies, medical conditions, or safety concerns related to attending children
  3. Ensure the venue is accessible and available at agreed-upon setup times
  4. Obtain necessary permissions and permits for the venue if applicable
  5. Supervise children during the event in conjunction with our staff
  6. Respect our staff and entertainers and ensure guests do the same
  7. Inform us of any changes to event details at least 7 days in advance when possible

6. Liability and Insurance

LittleFun Events maintains comprehensive public liability insurance covering our services and activities. However, we cannot be held responsible for:

  • Injuries resulting from children's behavior or failure to follow safety instructions
  • Loss or damage to personal property belonging to guests
  • Venue-related issues including accessibility, cleanliness, or facilities
  • Acts of third-party vendors not directly employed by LittleFun Events
  • Weather-related disruptions for outdoor events
  • Guest behavior or interactions outside our staff's control

Parents and guardians remain ultimately responsible for the supervision and safety of their children throughout the event.

7. Intellectual Property Rights

All content, designs, concepts, materials, and intellectual property created by LittleFun Events remain our exclusive property. This includes but is not limited to custom party themes, decoration designs, activity concepts, and proprietary planning methodologies.

You may not reproduce, distribute, or commercially exploit any of our proprietary materials without express written permission. Photography and videography of our event setups for personal use is permitted, but commercial use requires prior authorization.

8. Photography and Media Release

By booking our services, you grant LittleFun Events permission to photograph and record video at your event for marketing and promotional purposes, unless you explicitly opt out in writing. We will not publish images that identify children without parental consent.

If you wish to restrict photography or require us to exclude specific individuals from promotional materials, please notify us in writing at least 7 days before your event.

9. Force Majeure

LittleFun Events shall not be liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, public health emergencies, severe weather, transportation failures, or supplier defaults.

In such cases, we will work with you to reschedule the event or provide a refund of payments made, minus any non-recoverable costs already incurred.

10. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws. By using our services, you consent to such processing and warrant that all data provided is accurate.

11. Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good-faith negotiation between parties. If resolution cannot be reached within 30 days, disputes shall be resolved through mediation in Melbourne, Victoria, Australia.

These Terms of Service are governed by the laws of Victoria, Australia, and you agree to submit to the exclusive jurisdiction of the courts in Melbourne, Victoria.

12. Modifications to Services

We reserve the right to modify or discontinue any aspect of our services at any time. While we strive to maintain consistency, factors such as entertainer availability, supplier changes, or safety considerations may require adjustments to planned elements.

We will communicate any significant changes to your booked services as soon as possible and work with you to ensure satisfaction with any necessary modifications.

14. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Service will otherwise remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and any signed service agreement, constitute the entire agreement between you and LittleFun Events regarding the use of our services and supersede all prior agreements and understandings.
